Affray occurred in front of court house

A 29 year-old woman charged with affray which occurred in front of the Cowra Court House was told “you should know better” before escaping without conviction in the Local Court on November 27, 2024.

Emma Higgins, who was involved in the assault in front of the court house when she had no reason to be at court, was also told “your behaviour is unacceptable” by magistrate Rana Daher who placed the offender on a bond for 18 months, without conviction.

Police documents revealed the offence Higgins was charged with occurred outside court on April 24 after bumping shoulders with another person, who was also charged.

Higgins, 29, of Campbell Street, and the co-accused turned after bumping shoulders and engaged in a physical altercation.

Police said numerous slaps and punches were exchanged before several other court patrons intervened.

NSW Sheriffs Department staff and NSW Police, who were present at court, attended and separated both parties who claimed the other started it.

The accused, police said, having no lawful reason to be at court that day was issued with a move on direction while the co-accused was told to sit away from other persons until her matter was called for court.

The entire incident was captured on CCTV.

ASSAULT OCCURED AT PUB

A 37 year-old Cowra woman involved in an assault at a Cowra pub was placed on a Conditional Release Order, without conviction, when she appeared in the Local Court on November 26.

Police documents revealed Elisha Ingram of Wellington Street grabbed her victim’s hair and pushed her to the ground and a co-accused then kicked the victim.

This occurred before the parties were separated by the licencee and other patrons.

“You should know better,” magistrate Rana Daher told Ingram who pleaded guilty to common assault.

According to police documents tabled in court Ingram, 39, approached her victim from behind, grabbing her by the hair.

Police said the victim has suffered ongoing headaches, neck and back pain and is missing chunks of her hair.

COURT ALTERS DRIVING SUSPENSION

Representing herself before the Cowra Local Court on November 26 Ashleigh Thorn appealed a licence suspension imposed by Traffic NSW for fine defaults.

Magistrate Rana Daher described her traffic history as “absolutely shocking”.

Despite this Ms Daher amended Thorn’s suspension to six weeks starting on January 1, after hearing of her need for a licence as she was due to give birth in late December.

Thorn’s licence was suspended after she returned a positive result for cannabis during a drug test near Millthorpe.

Thorn was stopped for random testing.

OFFENDER ADMITS TO TAKING ICE

A Cowra man with what the court described as a “history of domestic violence” was placed on a two year Community Corrections Order and told to perform 80 hours of community service when he appeared in the Local Court on November 26, 2024.

Roy Carberry, 45, of Yarmnildine Place, pleaded guilty to common assault when he appeared before magistrate Rana Daher.

“I’m turning my mind to a lengthy CCO,” Ms Daher told Carberry’s legal representative adding “there is a clear link between drugs and alcohol and violent behaviour”.

“The offence is aborent, an aggravating factor is you have a history of similar offences,” Ms Daher told Carberry.

According to police documents Carberry became involved in an argument with his victim which turned heated before he struck the victim in the face.

Police said the victim retaliated before Carberry walked away.

Whilst speaking to police Carberry admitted to being under the influence of Ice with officers observing him to be evidently drug affected.

OFFENDER CLOSE TO JAIL SENTENCE

A 67 year-old man charged with assault, contravening an apprehended violence order and breaching an order was told he was close to a jail sentence when he appeared in the Local Court on November 26, 2024.

Beresford’s solicitor had asked the court for a community based order to be imposed after he pleaded guilty to the offences.

Finding the offences proven magistrate Rana Daher placed Beresford of Waugoola Road, Wyangala on a 30 month Community Corrections Order on a charge of common assault, a further order of six months for contravening an AVO before fining him $800 for assault and a further $800 for contravening a court order.

According to police documents Beresford was charged after an incident on November 6 during which he forced one of his victims into the corner of a room shouting loudly and being verbally aggressive.

Police said Beresford struck the victim over the head with a pack of cigarettes and struck the victim in the jaw with a closed fist.

The victim, according to police, informed a third person who Beresford also assaulted, grabbing this person by the arm, maintaining the hold for approximately five minutes “whilst delivering an extensive and abusive diatribe”.
